3rd November 2026 – (London) Britain has confirmed that Hong Kong British National (Overseas) visa holders will keep their existing five-year route to settled status under a sweeping “earned settlement” overhaul, while raising the English and income bars they must clear when they apply.
Home Secretary Shabana Mahmood set the new model before Parliament yesterday, ending the near-automatic grant of indefinite leave after five years for most migrants. How long someone waits will now turn on contribution and character. The highest earners may settle in three years; those earning more than 50,271 pounds and some public-service workers such as doctors, nurses and teachers after five; most others face a new default of ten years; and people who have breached immigration rules at least 20 years. Existing settled status will not be stripped from anyone who already holds it.
For Hongkongers on the BN(O) pathway, the Home Office says the five-year timetable remains outside the main earned-settlement framework, honouring earlier commitments alongside routes for immediate family of British citizens and members of the armed forces. BN(O) applicants will nonetheless have to meet strengthened minimum conditions that now apply more widely: English at CEFR B2 — roughly A-level standard as a foreign language, up from the previous B1 benchmark — and evidence of annual earnings of at least 12,571 pounds over a three-to-five-year stretch, together with the broader suite of character and contribution tests.
Government papers list tailored exemptions. People aged 65 and over may be excused the language and income requirements. Those under 18, and young adults aged 18 to 24 who arrived as child dependants, may be excused the earnings test. Applicants whose physical or mental condition prevents them meeting the standards may also be excused language and income rules. Couples will be allowed to combine earnings: a household total of 25,142 pounds over three years can satisfy the economic contribution bar even if one partner alone falls short of 12,571 pounds.
Anyone seeking settlement, whatever their arrival date, must first clear four non-negotiable conditions: a spotless criminal record (tougher than the old threshold of a 12-month suspended sentence); high-standard English; no debt owed to the taxpayer; and a record of sustained National Insurance contributions. Care workers who met their visa conditions and earned at least 25,000 pounds a year will still be able to settle after five years, in recognition of pandemic-era service, though the government says about a quarter who fall short will be offered a further five-year visa before they can apply. Officials say some 1,800 exploitative sponsors have already lost the right to hire foreign workers, and estimate that more than 500,000 people will wait longer than five years to settle.
Refugees on Home Office-approved safe and legal routes may settle after five years; others face 20 years, cut to ten if they work or study, while clandestine arrivals including small-boat crossings attract an extra decade that could stretch waits toward 30 years. Prime Minister Andy Burnham backed a system based on “control, contribution” and rewarding those who play by the rules. Ms Mahmood said settled status is among the most valuable rights Britain can offer and, from now on, “must be earned” — fair to newcomers who contribute, and fair to British citizens already here.
