Second-generation member of owner family of Fook Lam Moon Restaurant sued for mortgage default

10th April 2021 – (Hong Kong) Chui Pui Kun, the second-generation member of family owner of Fook Lam Moon Restaurant in Wan Chai, was sued by a company to pursue a mortgage default claim yesterday (8th). The plaintiff’s company requested the court to order Chui to surrender the property as security, that is, a Clovelly Court unit with a parking space on May Road, Mid-levels, and demand Chui to pay the expenses and legal costs of selling the property.

The plaintiff is Hammer Capital China Limited and the defendant is Chui. The complaint alleges that Chui applied for a mortgage loan from First Pacific Bank on 10th August, 1999. The creditor of the mortgage loan is the plaintiff now. The plaintiff demanded Chui to hand over the property and parking space under his name used a collateral to the plaintiff.

In 2020, Duncan Chui, the third-generation family member of Wan Chai Fook Lam Moon Restaurant was sued for debts several times in recent months. He was again sued in the High Court in September 2020 by a finance company. The plaintiff alleged that a company in which Duncan held shares and served as a director had a second mortgage where the restaurant was located last year, with a loan of HK$12 million, and Duncan served as the loan guarantor.
