19th April 2024 – (Hong Kong) HK Bio-Rhythm R&D Company Limited and its director were fined a total of HK$152,000 today for failing to comply with the Employment Ordinance (EO), marking a significant legal response to wage violations in Hong Kong. The sentencing took place at the Shatin Magistrates’ Courts, where both the company and the director admitted to their roles in the infringement.

The Labour Department (LD) charged the company and its director after it was discovered that they had deliberately neglected to pay approximately $703,000 in wages to four employees within the required seven-day period following the end of the wage periods. The director was specifically convicted for her part in consenting to, conniving in, or neglecting the wage payment breaches.

A spokesperson for the LD emphasized the verdict’s broader implications, stating, “The ruling sends a strong message to employers, directors, and responsible officers across all sectors that compliance with statutory wage timings under the EO is not optional.” The spokesperson further assured that the LD is committed to rigorous enforcement of the law to protect the statutory rights of employees and will not hesitate to take decisive action against any violations.
