Defence in Filipino domestic helper rape trial claims victim paid HK$150 to have consensual sex with male defendant

12th August 2022 – (Hong Kong) A Filipino female domestic helper claimed that four years ago her naked female employer told her in English that “Sir likes you and he will pay you.” She was then dragged into the master bedroom before being raped by the male employer. The employer and his wife were later arrested and charged with rape, aiding and abetting rape.

The trial continued today (12th). When cross-examining the victim by the defence, the defence put forward its version of the incident today, claiming that after receiving HK$150, the victim had sex with the male employer while the female employer was taking a bath. The defence described the incident as nothing more than a monetary transaction. However, the victim, X denied the accusation. The defence pointed out that X put the defendant’s son to sleep in the master room that night, the female defendant then went to take a bath. At this time, the male defendant asked X “Sleeping?” and gave her HK$100. X then had sexual intercourse with the male defendant. After the male defendant ejaculated, he gave X another HK$50. When the naked X was about to leave the master room, the female defendant had just finished taking a shower. As soon as she saw X, she scolded her and the male defendant. X has completely denied the defence’s claims.

The male defendant in this case, Chan (48), was charged with 2 counts of attempted rape and rape of X at his residence in Hung Fuk Estate, Hung Shui Kiu on 21st January, 2018. His wife, Lai (36), was also charged with 2 counts of aiding and abetting Chan to rape and conduct indecent assault on X at the same place on the same day. According to the confession of the victim X, she was 30 years old at the time of the crime. She had worked as a domestic helper in Jordan and Saudi Arabia before, and came to Hong Kong for the first time in November 2017 to work at the defendant’s home. The female defendant was the employer in the employment contract.
