20-year-old student sentenced to training centre for committing arson at school in Tsing Yi in 2020

7th July 2022 – (Hong Kong) Several glass doors at Lok Sin Tong Leung Chik Wai Memorial School in Tsing Yi were damaged and splashed with gasoline and inflammable objects pm 24th July 2020. 2 male students named Cheung and Kwan aged 17 and 20 respectively who were studying at the school were charged with 3 crimes including arson and criminal damage. They were tried in the District Court earlier. Cheung was found not guilty based on prima facie evidence while Kwan was convicted of arson with intent or reckless disregard for property damage. Kwan was convicted and sentenced to a training centre in the District Court this morning (7th).

The judge pointed out that arson is a serious crime, and offender is usually sentenced to several years in prison. However, considering that the defendant is still young, the sentence to the training centre is sufficiently punitive and deterrent, and it is beneficial to his rehabilitation. The judge suggested that the defendant be sentenced to a training order.

The judge also mentioned that the repair cost of the damaged school gate in the case was about HK$89,000. The defence pointed out that the defendant had no financial ability, and his father had no income because he could not go to the mainland to work, and the family depended on the income of the defendant’s two sisters. The judge pointed out that he did not intend to ask the defendant’s family to repay on his behalf, but the defendant should be held responsible for his actions.
